Terms of Service

These Terms of Service ("Terms") govern your access to and use of Matis Voice's voice AI platform and related services. By using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

Matis Voice provides AI-powered voice agent services that enable automated phone call handling, including:

  • Inbound and outbound call management
  • Speech recognition and natural language understanding
  • Text-to-speech voice synthesis
  • Integration with third-party services
  • Call analytics and reporting

3. Account Registration

To use our services, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be at least 18 years of age

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Make unsolicited or spam calls
  • Harass, threaten, or defraud others
  • Impersonate any person or entity
  • Transmit malicious code or interfere with our systems
  • Collect personal information without consent
  • Violate the TCPA, GDPR, or other applicable privacy regulations

5. Your Content

You retain ownership of content you upload to our platform, including knowledge base documents, configuration settings, and call recordings. By uploading content, you grant us a license to use, process, and store that content solely for the purpose of providing our services.

You represent that you have all necessary rights to the content you upload and that it does not violate any third-party rights.

6. Fees and Payment

  • Fees are based on your selected plan and usage
  • All fees are charged in US dollars unless otherwise specified
  • Fees are non-refundable except as required by law
  • We may change our fees with 30 days' notice
  • Overdue payments may result in service suspension

7. Service Level Agreement

We commit to the following uptime guarantees based on your plan:

  • Starter: 99.9% uptime
  • Professional: 99.9% uptime
  • Enterprise: 99.99% uptime (with custom SLA)

Service credits may be issued for downtime exceeding these commitments, as detailed in your service agreement.

8. Intellectual Property

Matis Voice retains all rights to our platform, technology, and branding. These Terms do not grant you any rights to our intellectual property except the limited right to use our services as described.

Feedback, suggestions, or improvements you provide may be used by us without obligation to you.

9. Third-Party Services

Our services integrate with third-party services (CRMs, payment processors, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Matis Voice SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold Matis Voice harmless from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or violation of any third-party rights.

13. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to our services will cease
  • We may delete your data after a reasonable retention period
  • Provisions that should survive termination will remain in effect

We may suspend or terminate your account immediately for violations of these Terms.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated with at least 30 days' notice. Continued use of our services after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Toronto, Ontario.
